Personal Injury Protection Auto Accident Claims Attorneys
If you are injured in a car accident in Massachusetts the Personal Injury Protection statute (PIP) under Massachusetts General Law 90, § 34 determines how your medical bills will be paid. Every Massachusetts automobile insurance policy has a provision for Personal Injury Protection benefits. Generally you are entitled to PIP coverage from the automobile insurance policy that was covering the automobile you were in at the time of the accident. So even if you were a passenger in a car that you didn’t own at the time of the accident and you have your own insurance policy, the policy of the car you where in at the time of accident will handle your PIP benefits.
These PIP benefits will pay for the medical bills, at the most $8,000, of any passenger or operator of a car involved in an accident. Generally payment of PIP benefits for medical expenses are paid as follows.
If You Don’t Have Private Health Insurance Or MedPay
(Massachusetts Heath, Medicare, or health benefits provided through the military aren’t considered private health insurance benefits) If you are not covered by a private health insurance provider then the PIP benefits will pay for the first $8,000.00 in medical expenses.
If You Have Health Insurance But No MedPay
PIP will cover first $2,000.00 in medical expenses. After PIP has paid $2,000 in medical expenses, any expenses in excess of $2,000 will be submitted to your private insurance carrier for payment. In the event that your insurance policy doesn’t cover a certain expense, course of treatment or medical procedure PIP will pay for those expenses up to $8,000.
If You Have MedPay But Don’t Have Private Health Insurance
PIP will pay the first $8,000 in medical expenses then MedPay will pay for any expenses in excess of $8,000 up to the MedPay policy limits.
If You Have Private Health Insurance And MedPay
PIP will pay for first $2,000 in medical expenses and any expenses above that $2,000 amount will be submitted to your private health insurance carrier for their review. Your private insurance carrier will likely deny the claim on the grounds that you have MedPay and MedPay will cover any medical expenses in excess of $2,000 up to the MedPay policy limit.
