Operating a motor vehicle without a valid drivers license is a law that is governed by Massachusetts General Law Chapter 90 section 10. The law states that no one under the age of 16 is allowed to operate a vehicle on a public way in Massachusetts without a valid drivers license.
The law has a further reach than it appears at first glance. For example anyone having a valid learners permit that operates a vehicle after the hours permitted by the learners permit would be in violation of this law. And anyone operating a motorcycle without a valid license to operate a motorcycle will be in violation even though they have a license to operate a motor vehicle. And anyone having a valid drivers license but operating a vehicle without the license in his or her possession ( driver left his her wallet on the kitchen counter and gets pulled over after leaving the house) would be in violation of this law.
In order to prove the offense of operating without a license the commonwealth will have to show the following:
- The defendant operated a motor vehicle;
- The defendant operated a motor vehicle on a public way; and
- The defendant operated the motor vehicle without having a valid license.
The legal definition of “operation” is any intentional manipulation of some mechanical or electrical part of the vehicle — like the gear shift or the ignition — which, alone or in sequence, will set the vehicle in motion.
