Indecent exposure is a crime governed by Massachusetts General Laws Chapter 272 Section 53.
Indecent exposure is a misdemeanor offense unlike open and gross lewdness and lascivious behavior, which is a felony offense. A conviction for Indecent exposure can result in imprisonment in a jail for up to six months.

To obtain a conviction for indecent exposure, the prosecution must prove the following beyond a reasonable doubt:
- The Defendant exposed his or her genitals to one or more persons;
- The Defendant did so intentionally; and
- The Defendant’s exposure offended one or more people.
Courts have considered the following conduct to be indecent exposure:
- Masturbating in public;
- Urinating in public;
- Engaging in sexual acts in public;
- Intentionally exposing genitalia in public;
- Getting the attention of neighbor while committing sexual acts in bedroom window;
- Standing further from the public urinal than necessary in order to expose genitalia; and
- Walking out to the mailbox naked.
It should be noted that exposing one’s pubic hair, pubic region, butt or breasts is not considered indecent exposure although doing so may constitute open and gross lewdness and lascivious behavior, a more serious charge that also carries stiffer penalties if convicted.
