Criminal Penalties for Possession of Percocet
Percocet requires a valid prescription for legal use.
Possession of Percocet is a serious crime in Massachusetts. Massachusetts General Laws Chapter 94C outlines the penalties for possession of Percocet. Percocet is a Class B Substance in Massachusetts. A conviction for illegal possession of Percocet carries the following penalties:
- 1st Offense: Up to 1 year in a House of Corrections and/or a fine of up to $1,000. An additional fine of $150 to $500. Loss of drivers license for 1 year.
- 2nd Offense: Up to 2 ½ years in a House of Corrections or County Jail and/or a fine of up to $2,000. An additional fine of $150 to $500. Loss of drivers license for 1 year.
Possession is defined as “direct physical control or custody . . . at a given time.” On the other hand, someone doesn’t necessarily need to have actual physical custody of the Percocets to “possess” it. An object is in someone’s possession without physical custody if he or she has knowledge of the object along with
- the ability to exercise control over the Percocets, either directly or through someone else, and
- has intent to exercise control over the Percocets.
For example, the law would consider you in possession of things you keep in the center console of your car, underneath the seat of your car, in your backpack or in your bedroom bureau drawer.
