Massachusetts General Laws 265 section 13 F allows a judge to sentence a defendant that is found guilty to a maximum of five years in prison. If a defendant is found guilty of his or her second offense they could face a maximum of 10 years in prison.
The prosecution must prove beyond a reasonable doubt that the defendant knew that the victim was an individual with intellectual disabilities. The statute doesn’t apply where an individual with intellectual disabilities commits an assault on another individual with intellectual disabilities.
