Reckless Driving vs Negligent Operation
Negligent operation of a motor vehicle is different than operating under the influence. However, it is common for a defendant to be charged with both offenses. Negligent operation charges are addressed at the same time as the OUI charges.
Reckless driving and negligent operation are basically the same thing. The prosecution does not need to prove that a specific person was endangered because of the defendant’s negligent operation in order to convict. All the prosecution needs to prove is that the defendant’s negligent operation could have endangered any member of the public that might have been on the street. Weather and road conditions, rate of speed, time of day, and the way the driver was operating the vehicle are some of the factors that will be taken into consideration when determining driving to endanger.

Negligent Operation Penalties
- Criminal Penalties: A fine of no less that $20 and not more than $200 or imprisonment for a minimum of 2 weeks but not more than 2 years.
- Registry Penalties: Suspended license for 60 days for first offense. A second offense that occurs within three years of a first offense will result in a revocation of license for one year.
