Not Guilty in 2019 trial for Drug Distribution Involving Death

Stoughton Police responded to the home of a victim that died of a heroin overdose. Stoughton PD found heroin on the victim and text messages on the victim’s phone showing the defendant shared heroin with the defendant earlier in the day. Stoughton PD subsequently arrested the defendant and found a large bag of heroin in his home which the defendant used to support his personal drug use/habit. Stoughton Police then charged the defendant with distributing the heroin to victim. Attorney Brendan J. Noonan cross-examined the forensic chemist from the Massachusetts State Police drug lab who conducted the forensic drug analysis of the heroin found on the victim and the heroin found in the defendant’s home. Through his examination, he was able to prove that the heroin found on the victim contained chemical compounds that where not present in the heroin found in the defendant’s home. This supported the defense theory that the heroin found on the victim which caused his death came from another source and not the defendant. This evidence coupled with the evidence elicited during Attorney Patrick J. Noonan’s scorching cross-examination of the Stoughton Police detective in charge of the investigation persuaded the jury to find the defendant not guilty of distributing heroin to the victim.

Not Guilty in 2017 trial for Manslaughter

Defendant drug-addict was charged with manslaughter for distributing heroin resulting in the overdose death of the victim. Attorney Brendan J. Noonan cross-examined the state medical examiner who conducted the autopsy of the victim, the forensic chemist from the FBI who conducted the forensic drug analysis on the heroin the defendant allegedly distributed to the victim shortly before the overdose death and the forensic chemist from the Massachusetts State Police drug lab who conducted the forensic analysis of the victim’s blood. Attorney Noonan also examined a forensic toxicologist that testified on behalf of the defense. Through these examinations, he was able to prove the following: (1) the victim had very high levels of heroin in her blood which could only be produced by a high purity heroin, (2) the heroin distributed by the defendant had a very low purity and could not produce the high levels of heroin detected in the victim’s blood, (3) the heroin distributed by the defendant did not contain fentanyl, (4) traces levels of fentanyl were detected in the victim’s blood, (5) fentanyl stays in the blood a very short time after it is consumed, (6) the victim consumed a high purity heroin laced with fentanyl a short period of time before death which was provided to the victim by someone other than the defendant.
