What are the minimum insurance requirements in Brockton?
In Massachusetts, car owners must have four types of mandatory insurance coverage in specific minimum amounts. Owners can purchase higher amounts for these four coverages and other optional insurance policies.
Bodily injury coverage
Car owners must have at least $20,000 in bodily coverage (and $40,000 for multiple victims) if the owner (or someone who has permission to use their car) causes a car accident and injures another person. Bodily injury insurance covers medical bills, lost income, pain and suffering, and other damages due to your injuries.
Personal Injury Protection (also known as PIP)
This insurance pays your medical bills and up to 75% of your lost wages and replacement services - up to $8,000. PIP pays for these damages regardless of fault. PIP coverage protects you, anyone you allow to drive your car, anyone living in your household, passengers in the vehicle, and pedestrians.
Uninsured coverage for bodily injury
This type of coverage protects the owner of a car, drivers who have permission to drive their car, household members, and passengers (if the passenger is not covered by another similar Massachusetts policy). The mandatory uninsured (UM) coverage amount is the same as the bodily injury mandatory coverage – $20,000 for each victim and $40,000 for all victims in one accident.
Uninsured coverage also protects you if a hit-and-run driver causes an accident.
The failure to have the proper minimum insurance is a crime in Massachusetts. The penalties include:
- A criminal record
- Imprisonment for up to one year
- A fine between $500 and $5,000
- The loss of driving privileges for 60 days.
It’s no excuse for a driver to say they couldn’t afford insurance or that their driving record prevents them from obtaining insurance.
Property damage
This coverage pays for the damage to another person’s property, such as their car. Owners must carry at least $5,000 in coverage.
What other insurance coverage can pay my damages?
According to the Commonwealth of Massachusetts, car owners should consider purchasing the following coverages:
- The four compulsory coverages. For each of the four types of mandatory coverage, owners should buy the most coverage they can reasonably afford. A Brockton car accident that causes a traumatic brain injury or any type of catastrophic or serious injury can be worth hundreds of thousands of dollars or even millions of dollars. $20,000 often isn’t enough to pay for a day or two in a hospital. Most new cars are worth $20,000, $30,000, or more. $5,000 just isn’t enough coverage.
- Underinsured (UIM) coverage. This coverage protects accident victims in Brockton if the value of their claim is more than the coverage that the responsible driver has. For example, if your claim is worth $100,000 and the driver who struck your car only has $20,000, you still need $80,000 in coverage. If you have enough UIM coverage ($100,000), you can receive the balance of the damages ($80,000) you deserve.
- Collision insurance. This coverage pays for the cost to repair or replace your damaged vehicle – regardless of fault.
- Comprehensive insurance. This coverage pays for non-accident damage to your vehicle, such as damage by vandalism, theft, falling objects, or other causes.
Other coverages may be available. Victims can always use their own health insurance coverage to pay their medical bills.
Who are the defendants in a car accident case in Brockton?
At The Law Offices of Gerald J. Noonan, we file car accident claims against all responsible parties. The defendants in a car accident case may include the driver and the owner of the car. The defendants may also include a driver’s employer, more than one driver, a hit-and-run driver, a manufacturer of defective car parts, the Massachusetts Department of Transportation, a seller of alcohol to a driver who is visibly intoxicated and causes your accident due to their intoxication, and other defendants.
Our Brockton uninsured motorist accident lawyers generally work to obtain the insurance proceeds from all responsible defendants before we file an uninsured motorist claim. We can explain when we need to file your UM claim and what damages you can receive. Just as with any accident case, we work to settle your claim through negotiation. If the case fails to settle, we can file a lawsuit to show the defendant is liable and how much your case is worth.
What is the value of a car accident claim in Brockton?
We’ve helped many clients obtain strong recoveries in personal injury cases, many for $100,000 and higher. Our attorneys demand compensation for all your economic and personal damages. We work with your doctors (and our own network of doctors when necessary) to verify what injuries you have, all the medical care you need, the cost of your care, and every way your injuries are affecting every day and every aspect of your life. Our layers also work with your employers, car body shops, and others to value your economic losses.
Our Brockton uninsured lawyers demand compensation for all your current and future:
- Medical bills
- Lost income and benefits
- Pain and suffering.
- Property damage
- Scarring and disfigurement
- Loss of bodily function
- Loss of life’s pleasures
- Loss of consortium (enjoyment of marital relations)
Even though the driver who caused your accident is uninsured, you can still seek to obtain a judgment against that driver. In that event, we will seek a judgment for all your damages and an additional amount for punitive damages – because the car owner/driver should know they must have insurance coverage.
