Criminal Penalties for Possession of Meth

Methamphetamine possession is a serious crime in Massachusetts. Massachusetts General Laws Chapter 94C outlines the penalties for possession of Methamphetamines. Methamphetamine is a Class B Substance in Massachusetts. A conviction for possession carries the following penalties:
- 1st Offense: Up to 1 year in a House of Corrections and/or a fine of up to $1,000. An additional fine of $150 to $500. Loss of drivers license for 1 year.
- 2nd Offense: Up to 2 ½ years in a House of Corrections or County Jail and/or a fine of up to $2,000. An additional fine of $150 to $500. Loss of drivers license for 1 year.
Additional penalties exist if the possession occurred within 1000 feet of public or private school grounds or within 100 feet of a playground. [See Drug Charges in a School Zone.]
In order to be convicted of possession of Methamphetamine the prosecution must prove the defendant:
- knowingly and
- intentionally
- possessed
- a controlled substance.

What is Methamphetamine? Methamphetamine is a highly addictive synthetic central nervous system stimulant. The drug comes in the form of a crystalline white powder that is bitter to the taste, odorless and quick to dissolve in water or alcohol. Crystal Meth looks like pieces of broken glass or blueish rock-like chunks.
Crystal Meth is usually smoked with a glass pipe. Meth can be taken orally or it can be smoked, snorted or dissolved in a liquid and injected. Both Crystal Meth and Meth are sometimes used as “club drugs.” Once taken, the drugs produce a quick, intense “rush” or “flash” of euphoria along with increased energy, alertness, heartbeat and respiration.
Chronic Meth users experience 7 stages of Meth use:
- The Rush — the rush is characterized by an increase in heart rate, respiration and blood pressure
- The High — the high is characterized by an increase in focus, alertness and energy
- The Binge — the binge is characterized by a period of uncontrolled drug or alcohol consumption. The Meth creates a continuous urge to maintain the high and this leads to additional drug and alcohol consumption.
- Tweaking — occurs when the binge is finished and the rush and high can no longer be maintained. A sense of emptiness and cravings overtake the user. Bouts of intense inching and insomnia follow.
- The Crash — The crash occurs when the body shuts down because it has been overwhelmed by the drug. This is characterized by long periods of sleep.
- The Hangover — the hangover follows the crash as the body returns in a depleted state dehydrated, starving and physically, emotionally and mentally wrecked. At this stage the users sees Meth as the solution to these problems.
- Withdrawal — The withdrawals bring depression, loss of energy and an inability to experience pleasure. Cravings emerge along with suicidal thoughts. Withdrawal is extremely painful and that is why 93 percent of people in active treatment return to drug use.
